General Terms and Conditions

1. Geltungsbereich

These General Terms and Conditions (GTC) apply to the use of the rankion.ai platform (hereinafter referred to as the "Platform" or "Service"), operated by Rankion GmbH i.G., Weidenweg 12, 74321 Bietigheim-Bissingen (hereinafter referred to as the "Provider", "we", or "us"), as well as all associated services.

By registering on rankion.ai and/or using our services, you agree to these terms and conditions. Deviating conditions of the user will not be recognized, unless we expressly agree to their validity in writing.

2. Leistungsumfang

rankion.ai is an AI-powered content platform that provides the following functions:

3. Registration and User Account

3.1 Voraussetzungen

Using the platform requires registration. You must be at least 18 years old and have full legal capacity. When registering on behalf of a company, you confirm that you are authorized to represent the company.

3.2 Pflichten des Nutzers

The user is obligated to:

• To provide truthful information when registering
• Treat the login credentials confidentially and do not share them with third parties
• To inform us immediately about any unauthorized use of the account

• Only one email address to be used for an account (no disposable emails)

3.3 Email-Verifizierung

Using the platform requires confirming your email address. Disposable email addresses (throwaway emails) are not allowed and can lead to immediate account suspension.

4. Prices and Payment

4.1 Credit-System

rankion.ai verwendet ein Credit-basiertes Abrechnungssystem:

• 1 Credit = 0,01 EUR(ein Cent)
• Credits werden nach Verbrauch von Ihrem Guthaben abgezogen
• The credit consumption varies depending on the function and scope (e.g., text length, image resolution)
• Typische Kosten: Artikel-Generierung 5-50 Credits, Keyword-Recherche 2-10 Credits, Bildgenerierung 5-20 Credits
• You can view your current credit balance at any time in your dashboard

4.2 Tarife

4.3 Zahlungsbedingungen

• Monthly subscriptions are due in advance
• Billing is handled through Stripe (credit card, SEPA direct debit)
• Subscriptions renew automatically unless canceled
• Credits expire at the end of the month (no carry-over to the following month)
• Additional credit packages are valid for 12 months
• All prices are subject to the applicable value-added tax

4.4 Kostenlose Testphase

The Starter plan is permanently free of charge. When upgrading to a paid plan, we can offer time-limited trial phases. The conditions will be displayed during the upgrade. After the trial period ends, the subscription will automatically switch to the paid plan unless it was canceled beforehand.

5. Rights of Use and Intellectual Property

5.1 Ihre Inhalte

You retain all rights to the content you generate or upload with rankion.ai. By generating content, you receive a worldwide, perpetual, non-exclusive, commercial license to use this content.

Wichtig:You are responsible for the legal review and use of AI-generated content. We recommend manual review before publication.

5.2 Unsere Rechte

rankion.ai, the platform software, the design, and all associated brands remain the sole property of Rankion GmbH i.G.. You only receive a non-transferable, revocable right of use for the duration of your membership.

5.3 Datennutzung zu Verbesserungszwecken

We reserve the right to use anonymized and aggregated usage data (not your content) to improve our services. Your actual texts and content will never be used for training AI models or for other purposes outside of your use.

6. Verbotene Nutzung

Folgende Nutzungen sind untersagt:

• Creation of illegal, defamatory, insulting, or discriminatory content
• Generation of content that infringes on copyrights or other third-party rights
• Spam, phishing or other fraudulent activities
• Reverse engineering, decompiling or disassembling the software
• Automated scraping or excessive API usage without permission
• Resale of generated credits or account sharing
• Circumvention of technical protection measures
• Erstellung von Inhalten zu illegalen Themen (Drogen, Waffen, Kindesmissbrauch, etc.)

In case of violations, we reserve the right to immediately block the account and take legal action.

7. Availability and technical requirements

7.1 Availability

We strive for an availability of 99.5% per month (excluding planned maintenance windows). Exceptions are:

• Force majeure (natural disasters, strikes, etc.)
• Failures of third-party providers (AI APIs, payment providers, hosting)
• Planned maintenance work (will be announced)
• DDoS attacks and other cyber attacks

7.2 Technical requirements

For using the platform, you need:

• A modern browser (Chrome, Firefox, Safari, Edge - latest version)
• Stabile Internetverbindung (mind. 2 Mbit/s empfohlen)
• JavaScript aktiviert
• Cookies enabled (for session management)

8. Limitation of Liability

8.1 Liability for content

rankion.ai is not liable for:

• Quality and accuracy of AI-generated content:The generated texts are suggestions and must be reviewed by you
• Facts and sources:Despite fact-checking, errors may occur
• Urheberrechtsverletzungen:You are responsible for the legal review
• Plagiate:Despite plagiarism check, no 100% guarantee can be given
• SEO/GEO-Erfolg:Rankings in search engines cannot be guaranteed
• AI Detection:We do not guarantee that AI Humanization bypasses all detection tools

8.2 Technische Haftung

We are not liable for:

• Data loss (regular backups are recommended)
• Failures of third-party APIs (Anthropic, OpenAI, Stripe, etc.)
• Compatibility issues with WordPress/Shopify installations
• Disruptions by third parties (hacker attacks on your systems)

8.3 Allgemeine Haftungsgrenzen

Liability is limited to:

• Intentional and gross negligence:Unlimited liability
• Personal injuries:Unlimited liability
• Slight negligence:Liability only in case of breach of essential contractual obligations, limited to foreseeable damages
• Maximum amount:In case of minor negligence, up to the amount of fees paid in the last 12 months

9. Termination

9.1 Termination by the user

You can cancel your subscription at any time at the end of the month:

• Termination directly in the dashboard under "Settings → Subscription"
• Termination by email to:support@rankion.ai
• Notice period: Until the last day of the billing period
• Fees already paid will not be refunded on a pro-rata basis
• Ihr Account bleibt bis zum Ende des bezahlten Zeitraums aktiv

9.2 Termination by the provider

We can terminate the contract:

• Ordentlich:Mit einer Frist von 30 Tagen zum Monatsende
• Extraordinary (without notice):In case of serious violations of these Terms of Service, especially illegal activities, payment default or misuse of the platform

9.3 Account Deletion

Upon account deletion:

• All your data will be deleted within 30 days (except legally required retention)
• You can export your content beforehand
• Verfallen nicht genutzte Credits ersatzlos
• If a restoration is not possible

10. Changes to the Terms of Service and Prices

10.1 Changes to the Terms of Service

We reserve the right to adjust these terms and conditions. For significant changes, we will inform you at least 30 days in advance by email. If you do not object within 30 days, the new terms and conditions will be deemed accepted. In the event of an objection, you have a special right of termination.

10.2 Price changes

Price changes will be announced at least 60 days in advance and will apply to the next renewal period. Existing customers will receive a protection of 6 months against price increases.

11. Schlussbestimmungen

11.1 Anwendbares Recht

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.

11.2 Gerichtsstand

The place of jurisdiction for disputes with merchants, legal entities under public law, or special funds under public law is Besigheim. For consumers, the statutory places of jurisdiction apply.

11.3 Salvatorische Klausel

Should individual provisions of these Terms and Conditions be or become ineffective, the effectiveness of the remaining provisions shall not be affected. The ineffective provision will be replaced by an effective one that comes closest to the economic purpose of the ineffective provision.

11.4 Online-Streitbeilegung

The European Commission provides a platform for online dispute resolution (ODR):https://ec.europa.eu/consumers/odr
We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
